Ordinance
A measure adopted by the French Government, after parliamentary authorisation, in an area normally reserved for legislation.
Under Article 38 of the Constitution, Parliament may authorise the Government for a limited period and defined subjects to legislate by ordinance. The ordinance is adopted by the Council of Ministers after consultation of the Council of State and enters into force on publication. A ratification bill must be tabled within the authorised period, and express ratification determines its legislative status.
Parliament authorises a six-month programme of ordinances to simplify a regulated sector.
An ordinance is distinct from both the enabling law and the later ratification legislation.
