Operative provisions
The part of a bill or amendment containing the precise legal wording intended to have effect if adopted.
In a bill, the operative provisions are its articles; in an amendment, they state the exact insertion, deletion or replacement proposed. Parliament votes on this wording rather than on the accompanying explanation. Once adopted, it changes the text under consideration and may eventually become part of the enacted law.
An amendment’s operative provision deletes paragraph 3, while its explanatory note gives the reason.
